Terms and Conditions for Bloka Tag

Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Bloka Tag mobile application (the "Service") operated by BLOKA ("us", "we", or "our").
Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the Service.
By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the Service.
1. Service Functionality
The Service uses Apple's Screen Time frameworks and Near Field Communication (NFC) technology to temporarily block access to user-selected applications on their iOS device. To activate and deactivate the blocking feature, the user must scan a compatible NFC tag containing the specific text "BLOKA". The Service also includes a limited-use "Emergency Stop" feature to provide a bypass mechanism in urgent situations.
An optional camera feature allows you to compare two images to determine whether they depict the same physical object. When you use this feature, the images you provide are transmitted to and processed by Google's Generative Language API (Gemini). See our Privacy Policy for details.
2. Intellectual Property
The Service and its original content, features, and functionality are and will remain the exclusive property of BLOKA and its licensors. The Service is protected by copyright, trademark, and other laws of both Italy and foreign countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of BLOKA.

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.
BLOKA does not warrant that a) the Service will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; or c) the Service is free of viruses or other harmful components.
5. Limitation of Liability
In no event shall BLOKA, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any unauthorized access to or use of our servers and/or any and all personal information stored therein; (iii) any interruption or cessation of transmission to or from the Service; (iv) any bugs, viruses, trojan horses, or the like which may be transmitted to or through our Service by any third party.
Your sole and exclusive remedy for any dissatisfaction with the Service is to stop using the Service. Our maximum liability to you for any and all damages, losses, and causes of action shall not exceed the amount paid by you, if any, for accessing the Service.

These Terms shall be governed and construed in accordance with the laws of Italy, without regard to its conflict of law provisions.
7. Changes
We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms and Conditions on this page. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms.
8. Auto-Renewable Subscriptions
The Service offers auto-renewable subscription plans ("Subscription") that provide access to premium features including unlimited camera verifications, removal of daily limits, and up to 5 custom Bloka objects.
8.1 Subscription Terms:
• Monthly Subscription: Automatically renews every month
• Annual Subscription: Automatically renews every year
• Payment will be charged to your Apple ID account at the confirmation of purchase
• Subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your App Store account settings after purchase
8.2 Free Trial:
If a free trial is offered, the free trial period will end when you purchase a subscription. Any unused portion of a free trial period will be forfeited when you purchase a subscription, where applicable.
8.3 Cancellation:
You may cancel your subscription at any time through your Apple ID account settings. Cancellation will take effect at the end of the current billing period. No refunds will be provided for any unused portion of the subscription period.
8.4 Price Changes:
We reserve the right to modify subscription pricing. Any price changes will take effect at the start of the next billing cycle after the change is communicated to you.

- Uploading images containing sensitive information, faces, or content that you do not have the right to share when using the camera feature.
